1. Application of General Terms and Conditions of Sale
1.1 All orders for products from Swisspastrycream.ch or one of its affiliates are governed by these Terms and Conditions of Sale, which will apply to the exclusion of all other conditions.
1.2 The general terms and conditions of sale will be communicated during each order validation process, the registration of your order is subject to acceptance. By placing an order you acknowledge that you have read, understood and accepted, without reservation, these General Terms and Conditions of Sale.
1.3 Swisspastrycream.ch reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on this website. Registering your order is subject to acceptance of the terms of sale, every order placed after the publication by Swisspastrycream.ch of the new version of its General Terms and Conditions of Sale implies acceptance of them.
2. Registration and conditions for placing an order
2.1 When you register on this website, you must ensure the accuracy and completeness of the data you provide. It is very important that you provide us with accurate delivery details so that the delivery can be executed correctly : house or building number, door code, floor, etc…
2.2 Please inform Swisspastrycream.ch of any change of address and other changes by updating your personal data on this site as soon as necessary.
2.3 Any person placing an order on the site declares to be of legal age and have legal capacity.
3. Password
3.1 You must choose a password when registering in order to use this site. This password is strictly confidential and should not be disclosed to third parties.
3.2 You are solely responsible for the use of your password and all orders placed using this password, even those without your knowledge.
3.3 If you know or suspect that a third party knows or is using your password, you must immediately inform Swisspastrycream.ch.
4. Orders
4.1 By placing an order on this site, you submit an offer whereby you agree to purchase the products you have selected and accept the terms and conditions of sale.
4.2 The products (creams) proposed by Swisspastrycream.ch on this site are fresh products with a minimum 20-day shelflife.
4.3 The orders are dispatched from Monday to Thursday until 14h in the afternoon (2 pm), priority shipment by Swiss Post or another carrier.
5. Order confirmation
5.1 Swisspastrycream.ch will send you an email confirmation of your order. This email constitutes our acceptance of your order and is the conclusion of the contract of sale between you and Swisspastrycream.ch. In other words, the orders you place on this website do not constitute a binding contract as long as they have not been confirmed by Swisspastrycream.ch.
5.2 Swisspastrycream.ch only delivers prepaid orders.
5.3 The data recorded by Swisspastrycream.ch constitutes irrefutable proof of the order or the transaction. The data recorded by the payment system is irrefutable proof of financial transactions.
6. Price
6.1 The price payable (expressed in Swiss francs – CHF) for the products you order is the one shown on this website on the date of the order, VAT included. Delivery fees are included in the indicated sales price.
6.2 Swisspastrycream.ch reserves the right to change prices at any time.
7. Delivery
7.1 All orders confirmed by Swisspastrycream.ch will be delivered to the address indicated on the order.
7.2 Deliveries are made from Tuesday to Friday, priority delivery, by the Swiss Post or another provider. Deliveries in Switzerland exclusively.
7.3 The presence of the customer during the delivery is strongly recommended so that the goods are delivered in optimal conditions.
7.4 In case of absence of the customer, the parcel will be deposited in front of the door of the indicated address.
7.5 All optional information, other than door code and floor number, will not be taken into account.
7.6 The customer becomes responsible for the products once delivered, even if they are deposited at the door of his home or business adress.

8. Reception of fresh products
8.1 The Discovery kit contains 3 Swiss Pastry Cream fresh products (creams) and 12 tartlets (for free). The creams are packed in an isothermal bag which is a gift from Swisspastrycream.ch. This isothermal bag can ensure an adequate conditioning of approximately 30 to 40 hours provided that the goods are not exposed to heat (sun, radiator, etc …).
8.2 Upon receipt, Swiss Pastry Cream products must immediately be stored in a cool place (max 5° C).
9. Checking the goods, returns
9.1 It is the customer’s responsibility to check the quantity and conformity of the goods upon delivery.
9.2 If the customer finds that merchandise is missing or damaged, he must inform Swisspastrycream.ch immediately upon receipt of the goods, ie the day of delivery with supporting evidence, see page Contact.
9.3 Swiss Pastry Cream products undergo a quality control before shipment, therefore no qualitative claim (taste, consistency, texture, color, etc …) will be taken into account. Products whose intrinsic qualities do not correspond to the customer’s expectations (eg gustatory properties), and fresh products whose alteration is due to late receipt by the customer are not refundable.
10. Payment
10.1 Credit card payment is due immediately. The data of your credit card is encrypted for security reasons.
11. Force majeure
11.1 Swisspastrycream.ch will do its utmost to fulfill its obligations but can not be held responsible for delays or failure to deliver caused by circumstances beyond its control, such as accidents, strikes, wars, natural disasters or others that prevent the production, transportation or delivery of products.
11.2 In case of delay, Swisspastrycream.ch will fulfill its obligations as soon as possible and reserves the right to postpone the delivery day in exceptional circumstances
12. Protection of personal data
12.1 Regardless the nature of the personal data concerning you which is made available to us, whether we are entitled to ask for it in accordance with these terms of sale, or whether we register it in an automated way, we are committed to make every effort to treat it with the strictest confidentiality, ensuring its protection and making use of it only to complete your requests or improve the services that may be offered to you.
13. Retargeting or Remarketing
13.1 This website uses Google’s retargeting service (or remarketing) which allows Google, thanks to the use of cookies, to identify visitors who have been on our site and submit them to online advertisers once that they left the site. 14.1 These General Conditions of Sale are governed by Swiss law.
